Facing problems at work due to a drink drive charge? Speak to our recommended drink drive solicitors.

If you have been dismissed within the last 3 months from a job you had for 2 years or more, you may have a claim for unfair dismissal.

You might also have a claim if your job started before 6 April 2012 but you were there for less than 2 years.

Whether or not you can claim unfair dismissal depends on:

  1. The reason for the dismissal
  2. The procedure your employer carried out before dismissing you

You may be able to claim “automatically unfair dismissal” if you were dismissed for one of the following reasons no matter how long you were employed:

  1. Pregnancy, maternity or other family reasons
  2. You made a request for flexible working
  3. You are a whistleblower
  4. You made a health and safety complaint
  5. You complained about breach of your statutory rights
  6. You are on a blacklist
  7. You refused employee shareholder status
  8. You refused Sunday work
  9. You refused to work more than 48 hours per week or insisted on taking your statutory holiday
  10. You attended jury service

Contact us if you think you may have been unfairly dismissed.
