Employees and job applicants who have a cancer diagnosis are protected by the disability discrimination provisions in the Equality Act. Cancer is automatically treated as a disability for the purposes of the Equality Act.

Employees and job applicants are protected from

  • Direct discrimination because of the cancer
  • Harassment related to cancer
  • Indirect discrimination: policies, procedures and practices that put disabled persons (including cancer sufferers) at particular disadvantage unless they can be justified
  • Discrimination because of something arising from the cancer (such as a need to attend hospital appointments) unless it can be justified

Employers are also required to make reasonable adjustments to remove substantial disadvantage caused to disabled employees by their policies, procedures and practices or physical features of the premises. This could be anything from adjusting hours to allow you to attend medical appointments to redeploying you into a different role.
