Parents and carers have the right to request flexible working, such as working part time hours, changing the hours they work or working from home. An employer can only refuse a request for a sound business reason. If the employer refuses to consider the request or refuses it based on incorrect facts, the employee can complain to the Employment Tribunal.

As most parents making requests are women, you might also have a claim for indirect sex discrimination if a request for flexible working is refused. Your employer would have to show that their refusal was a proportionate means of achieving a legitimate aim.

Men who are refused flexible working could bring a claim for direct sex discrimination if they can show a woman in the same position would have had a request granted.
