Claims for pregnancy and maternity discrimination or unfair dismissal must be brought within 3 months. So for example if you were passed over for promotion on 19 July, your Tribunal claim needs to be with the Tribunal by 18 October.

Pregnant women and new mums have lots on their plate and might not feel up to bringing a claim or want to put it off.

It is possible to get an extension of time if you can show a good reason why you couldn’t bring a claim within the usual time limit. This is however risky and it is unlikely that a Tribunal would accept a late claim simply because the 3 months included the birth of your baby. Women severely affected by post natal depression and not able to claim or speak to a lawyer might have more success but they would need medical evidence to support this argument. Even with this, the claim won’t get off the ground until a Tribunal makes a decision on extending time, which can take several months.
